A Federal Court case continues into the banning of a super trawler, the Commonwealth rejecting claims the ban was improperly executed.

Federal Parliament imposed a two year ban on the Dutch ship Abel Tasman after Seafish Tasmania contracted the floating fish factory to catch an 18,000 tonne mackerel and red bait quota.

Environmentalists were in uproar when the 9,500 tonne behemoth rolled into Australian waters, the ban was imposed after Environment Minister Tony Burke claimed current legislation did not allow for a vessel of the Abel Tasman’s size or hauling potential.

Presiding judge Justice John Logan reportedly said the ban was ‘inelegantly drafted’, the trial should wind up today but no decision is expected this week.
